EB-2 NIW 
National Interest Waiver

The EB-2 NIW (National Interest Waiver) Immigrant Visa is for individuals with exceptional abilities in various fields who significantly benefit the United States. Unlike the EB-1A visa, it allows individuals to waive the job offer requirement by demonstrating their work's national interest. Applicants must show their work's impact on advancing and benefiting the nation.

Explanation

The National Interest Waiver application is a permanent residence petition that allows for a waiver of the job offer requirement for individuals. Usually, a professional who wishes to work in the U.S. must undergo the long and arduous labor certification process, but if the individual can prove that, he or she is an: 

  1. Individual of Exceptional Ability or an Advanced Degree Professional; and 

  2. Is involved in an activity which could prospectively benefit the National Interest;

Exceptional Ability
