What happens if you receive a NOID (Notice of Intent to Deny) on an EB-1A application?

A NOID can occur for various reasons, often because the evidence provided does not fully convince the officer of the applicant's qualifications. For instance, a NOID on the final merits for an EB-1A filing indicates that, despite meeting the initial criteria, the overall case did not convincingly demonstrate to the officer, during their final assessment, that the applicant has extraordinary ability.



If you receive a NOID, here are the steps you should consider:

2. Highlight Achievements: Emphasize the significance of the achievements in each of the granted categories.


3. Provide Additional Evidence: Submit further documentation and expert testimonials to bolster the case.


4. Address Specific Concerns: Directly and comprehensively respond to the issues raised in the NOID.
